Matrix Sea Foods India Limited (“Matrix Sea Foods India Limited” / “we” / “us” / “our” / “Company”) is a public Limited Company incorporated in India, and is engaged in the business of providing aquaculture solutions aimed at enhancing the quality and productivity of shrimp ponds (“Services”) rendered through its mobile and web-based application that is made available to its users (“you” / “your” / “user”). Such application is individually and collectively hereinafter referred to as “Platform”.

This Privacy Policy, will be amended from time to time (“Policy”) and all such amendments form part and parcel of the Platform’s integral terms and conditions by this reference. This Policy governs the collection, usage, sharing practices, and protection of the information obtained through the use of our Platform.

APPLICABILITY

This Policy applies solely to our Platform and does not extend to the websites of our business partners, corporate affiliates, or any other third parties. Personal details such as Name, Date of Birth /Age, Gender, Aadhar number, photograph, or other sensitive information collected as required to render specific services and/or regulatory compliance; ii. Contact-related information such as Residential address, Phone number, and E-mail address; iii. Location data (GPS) collected with your consent for providing location-based services; iv. Transaction-related data such as payment information, responses to offers; v. Login credentials including Login ID and Password; vi. Information entered into our system while using the Services/Platform; and vii. Real-time information collected from pond sensors voluntarily posted by users in forums to avail of technical consultations.

While using the Platform and/or our Services, you shall have the option to withdraw your consent to use such Information at any time. Such withdrawal of the consent must be communicated in writing to us at hello@matrixseafoods.in. However, we reserve the right to restrict further access to the Platform and/or provide any Services to you upon such withdrawal of consent.

HOW IS THE INFORMATION COLLECTED?

We may collect the Information either actively (as mentioned above) or passively. To improve the responsiveness of the Platform, certain Information can be passively collected using various technologies and means, such as Internet Protocol (IP) addresses, cookies, and navigational data collection.

As mentioned above, the Platform uses Internet Protocol (IP) addresses. An IP address is a number assigned to your computer by your Internet service provider so you can access the Internet and is generally considered to be non-personally identifiable information, because in most cases an IP address is dynamic (changing each time you connect to the Internet), rather than static (unique to a particular user’s computer).

By providing Information and/or accessing the Platform, you consent to us collecting, storing, using, and disclosing the Information for the purposes and to the persons (as applicable) outlined in this Policy (Amended from time to time).

We acknowledge that the current operations are within India and have plans for future global expansion. Therefore, this Policy may be amended from time to time to include compliance with additional Applicable Laws and Regulations as required when expanding into international markets.

DISPUTE RESOLUTION

Upon any failure to resolve the dispute by the Grievance/nodal officer appointed for this purpose under this Policy within 30 (thirty) days, the dispute shall be referred to Arbitration in accordance with the provisions of Arbitration and Conciliation Act, 1996. All disputes arising from or in connection with this Agreement shall be referred to and finally settled by arbitration in accordance with the Arbitration and Conciliation Act, 1996, presided by a sole arbitrator appointed by the Madras High Court on an application by any of the Party(ies) to this Agreement. Judgment upon the arbitral award may be entered in any Court having jurisdiction over the Parties or their assets. The seat and venue of the arbitration proceedings shall be Hyderabad. The arbitration proceedings shall be conducted in the English language. The award of the Arbitral Tribunal shall be final and binding on the Parties.

NOTIFICATION OF CHANGES IN THE PRIVACY POLICY

We review and updates its Privacy Policy every quarter to ensure the compliance with applicable laws and regulations. We reserve the right, at our sole discretion, to amend, modify, add, or remove any portion of this Policy, in whole or in part, at any time. We strongly advise the user(s) to regularly review this Policy on our Platform for any updates. Using the Platform after the effective date of any amendment(s) to the Policy constitutes your acceptance of the revised terms.
